Tharaka legislator Gitonga Murugura alias GG has lauded a 5 judges bench from the high court of Kenya that has ruled that the ongoing constitution ammedment(BBI) is unconstitutional and thus it is null and void.
According to the legislator,the judges upheld the will of majority of kenyans whose voices have been silenced by selfish leaders.
“I want to laud judges Proffesor Joel Ngugi, George Odunga,Jairus Ngaah,Chacha Mwita and Terresia Matheka for upholding the will of majority of Kenyans by rulling against the building bridges initiative that was unlawfully insituted.From the beginning I faulted BBI since it had nothing to benefit Kenyans since it is an initiative driven by two individuals,” Gitonga said.
Further, the MP said the ruling is an indicator that the judiciary is an independent body that should not be compromised by the executive for Kenyans to get justice.
Gitonga revealed that some MPs were bribed to pass the document against the will of Kenyans but fortunately the court proved that the 83 members of parliament who voted against the document had the good will of Kenyans at heart.
“The 83 members who stood against the unlawful initiative had to risk intimidations bribing and other sorts of evils to go against 235 members who yielded to the demands of their masters to vote in its favour,” he said.
Therefore he admitted that the parliament has been compromised making it difficult for members to debate independently.
Yesterday a bench of 5 judges from the high court of Kenya delt a major blow to BBI document in their ruling declaring BBI as illegal, constituted without a legal framework.
In the ruling, justice Jairus Ngaah argued that a constitutional amendment can either be initiated by a parliamentary initiative or a popular initiative.
“It is clear that the Constitution amendment bill 2020 is an initiative of the president.The president is not an MP, cannot directly purpot to initiate a constitutional ammedment,” justice Ngaah argued.
Finally the Tharaka mp welcomed any intended appeal on the ruling saying the BBI will not see the light of the day no matter what.
